Hello Everyone,

On February 3, 2006, the MOE EA Approvals Branch informed the City and the Kanata West Owners' Group that the integration provision can not be followed and that the Class EAs being prepared for the Kanata West development area must be separated from the planning process for the plans of subdivision. This decision was made in consideration of the public concerns, City's submission, Mattamy Home's submission, Q&A meeting with staff held January 24th, and advice from MOE legal council, Minister council and MMAH. The MOE felt that the scale of the projects was too large to attached to two plans of subdivision as; 1) they only represented a small geographical area of Kanata West; and, 2) a vast number of projects were situated outside the boundary of the subdivisions. They felt this created a high number of uncertainties related to the City's approach in terms of approval authority, appeal mechanism, and public's ability to raise concerns on identified projects.

The MOE recognizes the great deal of work done to date on these projects. They suggested that the work be "repackaged" with a different end point being the Minister of Environment not the OMB. The MOE EA Approvals Branch provide some options for the City's consideration in terms of Class EA approaches. Based on MOE's advice and follow up discussion with MOE staff that took place on February 15th, the City and KWOG as co-proponents are repackaging the three separate Class EA studies as follows:
Please find attached a new schedule based on the revised approach for your information. The revised approach includes a public meeting on March 7th as well as obtaining City Council approval on the Class EAs prior to the issuance of the three Notice of Completions.
